Intellectual Property Regulations

As a platform for artists, creators and artisans, Baob'Arts takes intellectual property rights very seriously. We follow intellectual property laws and industry best practices to maintain the integrity of our creative marketplace. This Intellectual Property Policy explains how we handle claims of infringement, how authorized parties can submit formal notices of infringement regarding content on our marketplace, and how Baob'Arts sellers can respond when their product sheets or their shops are the subject of an opinion.

1. Role of Baob'Arts

Baob'Arts is a marketplace made up of individual third-party sellers who each manage their own shops, establish their own policies, and are responsible for their inventory and shipments, as well as complying with the law. We provide a marketplace, but Baob'Arts does not manufacture products, manage inventory or deliver items on behalf of our sellers. Content uploaded to the Baob'Arts Marketplace is generated by independent sellers who are not employees, agents or representatives of Baob'Arts. Sellers must ensure that they have all necessary rights for their content and that they do not infringe or violate the rights of third parties by posting such content.

Baob'Arts reserves the right to deactivate any listing, store, or account that we believe violates our Terms of Service, including these Intellectual Property Rules or our Prohibited Items Rules. Baob'Arts also reserves the right to take action against any person who does not comply with Baob'Arts' Intellectual Property Regulations or our Terms of Use.

Baob'Arts cannot speak on behalf of intellectual property owners, and is not in a position to offer legal advice or make legal decisions regarding a shop's failure to respect the intellectual property of 'another person. Baob'Arts will remove materials flagged as potentially infringing intellectual property when proper notice is provided.

2. Notice of Intellectual Property Infringement

Baob'Arts endeavors to respond promptly upon proper receipt of a notice of intellectual property infringement by removing or disabling access to the item alleged to have infringed. When Baob'Arts removes or deactivates access in response to a notice, Baob'Arts makes reasonable attempts to contact the member concerned, to provide information about the notice and the deletion and, in the case of alleged copyright infringement, to provide information about the counter notice. Baob'Arts may also provide a copy of the notice of infringement, including the name and email address of the person responsible for the allegation, to the Member concerned.

Please use the Baob'Arts Allegation Form to provide notice of alleged infringement to Baob'Arts' designated DMCA agent, and for other intellectual property claims: www. baob-arts.com/legal/ip/report. Using this form allows us to process your allegation as quickly as possible.

Baob'Arts may request additional information before processing a review, such as verification of the identity of the person making the allegation or documentation regarding the right in question. Baob'Arts may reject reviews or counter notices containing information that we believe to be false, fraudulent, incomplete or otherwise submitted in bad faith. Baob'Arts also reserves the right to take action against any person who does not comply with this regulation.

3. Notice of Dispute

In accordance with the Digital Millennium Copyright Act (DMCA), Baob'Arts accepts counter notices only regarding copyright notices. When 'Baob'Arts receives a DMCA counter notice, we will provide a copy of the counter notice to the original complaining party. The deleted article may be replaced or access to it restored 10 days after the counter notice is processed, unless the copyright holder takes legal action against the alleged infringing party and notifies Baob 'Arts of this lawsuit. 4. Repeated offenses

Baob'Arts revokes the selling privileges of members subject to repeated or multiple notices of intellectual property infringement in appropriate circumstances and at Baob'Arts' discretion. If we believe a member has attempted to open a new store after the original account was revoked, we reserve the right to refuse all services to that member. These measures apply to any accounts that we believe are associated with or managed by the member concerned. In accordance with our Terms of Use, Baob'Arts reserves the right to terminate account privileges at any time, for any reason and without notice.

5. Infringement Notice Withdrawals

Baob'Arts only accepts notice withdrawals directly from the intellectual property owner, or their authorized representative, who submitted the claim. The takedown must clearly indicate that it concerns the official takedown of an allegation, and provide sufficient information identifying the member and/or the content concerned (for example, by providing the user name, the name of the store and the URLs of the files Baob'Arts products).

Once Baob'Arts has received an official takedown of a notice of infringement, Baob'Arts will make reasonable efforts to contact both parties involved to confirm receipt with the party submitting the takedown and to notify the member affected by the withdrawal. Please note that intellectual property infringement issues are reviewed on a case-by-case basis, and a withdrawal of an allegation does not guarantee a change in the status of a member's store.
